The figure of the Authorised Representative (AR) exists in several European Directives (namely the WEEE Directive) and aims to ensure the existence of local, contactable entities, which, representing non-resident companies, can enforce local obligations on their behalf.

In Portugal, local legislation (Decree-Law 102-D of 2019) determines that all non-resident companies that place on the Portuguese market, directly to end users: Electrical equipment, batteries, oils, tires, vehicles, and any product as long as it is packaged, have to appoint an Authorised Representative.

The Authorised Representative for the companies that place these products, has the obligation to register them in the national registry, to hire take-back systems, to periodically declare to these entities the number of products placed on the market by each of their representatives, and to serve as an interface between these and local authorities.

No, not at all, if all your sales to Portugal are made through Portuguese distributors (i.e. if you are invoicing local distributors only), you do not need to have an AR in Portugal.

Just make sure your distributors are registered at APA (Portuguese Environmental Agency) and declare to them the products they import from you.
 
However, besides the local distributors, if you sell online or by other distant means to Portuguese end-users (i.e. invoicing from outside Portugal for Portuguese end-users), you need to have an AR in Portugal.

This means you do not have to worry if your distributors are or aren't complying with their local obligations (that is registering your products and reporting them to the national registration entity and having contracted take-back systems).

Under our umbrella, all sales made by each of your Distributors, are dully registered and reported, avoiding possible failure and unnecessary company exposition to no compliance situations.

We take care of all the bureaucratic parts of this process, issuing a declaration to each Distributor exempting them from the obligations of registering and declaring your products to the authorities involved.
