The figure of the Authorised Representative (AR) exists in several European Directives (namely the WEEE Directive) and aims to ensure the existence of local, contactable entities, which, representing non-resident companies, can enforce local obligations on their behalf.
In Portugal, local legislation (Decree-Law 102-D of 2019) determines that all non-resident companies that place on the Portuguese market, directly to end users: Electrical equipment, batteries, oils, tires, vehicles, and any product as long as it is packaged, have to appoint an Authorised Representative.
The Authorised Representative for the companies that place these products, has the obligation to register them in the national registry, to hire take-back systems, to periodically declare to these entities the number of products placed on the market by each of their representatives, and to serve as an interface between these and local authorities.
